FDA Releases Compliance Guide on Nutrition Labeling

AMS Tart Cherry Marketing Order Referendum
AMS published in the Federal Register a directive that a referendum be conducted among eligible growers and processors of tart cherries grown in the States of Michigan, New York, Pennsylvania, Oregon, Utah, Washington, and Wisconsin to determine whether they favor continuance of the marketing order regulating the handling of tart cherries produced in the production area. The referendum will be conducted from March 9 through March 30, 2020. The marketing order authorizes quality regulations, research and promotion programs, and volume control for tart cherries. AMS Publishes Draft Testing Methods for GMOs
On July 29, 2016, Public Law 114-216 amended the Agricultural Marketing Act of 1946 (7 U.S.C. 1621 et. seq.) (amended Act) to require USDA to establish a national, mandatory standard for disclosing any food that is or may be bioengineered. In accordance with the amended Act, USDA published final regulations to implement the Standard on December 21, 2018 (83 FR 65814). The regulations became effective on February 19, 2019, with a mandatory compliance date of January 1, 2022. Foods that do not contain detectable modified genetic material are not bioengineered foods and do not require disclosure under the Standard. Under the definition of bioengineered food at 7 CFR 66.1, food does not contain modified genetic material if the genetic material is not detectable pursuant to Sec. 66.9. AMS has released draft instructions regarding acceptable testing methodology used to satisfy that a food does not contain detectable modified genetic material. USDA is accepting comments on the draft instructions until March 4, 2020.
APHIS To Launch Mandatory Filing Requirements in ACE on August 3
Beginning on August 3, APHIS intends to begin applying Harmonized Tariff Schedule (HTS) flags, which will alert filers who opt to submit data electronically whether APHIS import data is or may be required. Importers or brokers using ACE must enter APHIS-required import data when they receive an APHIS-specific HTS flag in order to complete their entry in the system. More information here.
