CBP: Canada and Mexico Tariffs of 25% Start March 4

U.S. Customs and Border Protection tonight published Cargo Systems Message Service notices #64297449 and #64297292 regarding Canada and Mexico tariffs. The notices instruct customs brokers and the importing community that effective 12:01 am eastern standard time, all products of Canada and Mexico, including food, are subject to an additional 25% ad valorem tariff.

CSMS #64297449 states that all products of Canada must be filed with an additional tariff code of 9903.01.10 which imposes the 25% tariff.

CSMS #64297292 states that all products of Mexico must be filed with an additional tariff code of 9903.01.01 which imposes the 25% tariff.

Standards for the tariffs are to be applied for determining country of origin under these new tariff codes include both:

  1. Substantial Transformation – if the last country of substantial transformation of the good before importation was Canada or Mexico the additonal tariffs apply.
  2. USMCA/NAFTA Rules of Origin – if the good is of Mexico or Canada origin pursuant to 19 CFR Part 102 the additional tariffs apply.
