FDA Reminds Industry of Enforcement Discretion for Agricultural Water Compliance Dates
FDA reminds produce stakeholders that the Agency previously announced its intention to exercise enforcement discretion for all of the agricultural water requirements for covered produce (other than sprouts). This includes exercising enforcement discretion related to the January 26, 2022 compliance date for the pre-harvest, harvest and post-harvest agricultural water requirements in the FDA FSMA Produce Safety Rule for the large covered farms.
FDA Proposed Rule on Food Contact Substance Notification
FDA is proposing to amend its regulations relating to the procedures by which the agency determines that a premarket notification for a food contact substance (FCN) is no longer effective. The proposed rule, if finalized, would, among other things, ensure that manufacturers or suppliers have the opportunity to provide input before we could determine that an FCN is no longer effective.
FSIS Revises Directive on Exported and Returned Products
This directive provides instructions and procedures for the Office of Field Operations, Recall Management and Technical Analysis Division, inspection program personnel, and Office of Investigation, Enforcement and Audit to follow when meat, poultry, and egg products bearing the mark of inspection are exported from and subsequently returned to the United States.

APHIS is advising the public of its decision to revise the requirements relative to the importation into the United States of plums from Chile to allow for fumigation as a mitigation for grapevine month in addition to irradiation.

FDA CORE Outbreak Investigation Status Update
This week’s updates are:
- The outbreak of four illnesses of E. coli O121:H19 (reference# 1050) has been linked to romaine lettuce. The information collected over the course of this investigation indicated that romaine lettuce was the likely source of this outbreak; however, it appears that this outbreak is over, and there is no actionable advice for consumers. FDA has been conducting a traceback investigation and other activities in an effort to learn more about possible sources or routes of contamination.
